1. Overview

OmniShield respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond to clear notices of alleged copyright infringement that comply with the requirements set forth below.

Important: OmniShield is a privacy-preserving VPN. We do not host user content, and we do not retain logs that could link a network packet to a specific subscriber. Users are solely responsible for the traffic they generate. We will, however, terminate the accounts of repeat infringers when properly notified.

2. Designated Agent

3. Filing a DMCA Notice

A valid DMCA notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or an authorized agent.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the allegedly infringing material, including a URL or sufficient information to locate it.
  4. Your contact information: full name, address, telephone number, and email.
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Notices missing any of these elements will be returned and may not be acted upon.

4. Counter-Notice Procedure

If you believe your content was removed in error, you may submit a counter-notice with:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and its previous location.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
  4. Your name, address, telephone number, and a statement consenting to the jurisdiction of the appropriate court.
  5. A statement that you will accept service of process from the original complainant.

Counter-notices should also be sent to [email protected] with the subject [DMCA Counter-Notice].

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, OmniShield has adopted a policy of terminating accounts of users who are deemed, in our reasonable discretion, to be repeat infringers. We may also, at our sole discretion, limit access to or terminate the account of any user who infringes any intellectual property rights, regardless of whether there is any repeat infringement.

6. False Claims

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages. Do not make false claims.
