Terms of Service

1. Acceptance of Terms

By creating an account, paying for a plan, or otherwise using OmniShield ("the Service", "we", "us"), you confirm that you have read, understood, and agree to be bound by these Terms of Service, our Privacy Policy, our Acceptable Use Policy, and our Refund Policy. If you do not agree, do not use the Service.

2. Service Description

OmniShield is a Virtual Private Network (VPN) that encrypts your internet traffic and routes it through one of our egress nodes. The Service supports four stealth protocols designed to defeat deep packet inspection and active probing: VLESS+Reality, VLESS+XHTTP, AmneziaWG 2.0, and Hysteria2. Egress nodes are deployed across 8 countries.

3. Account Creation

• No email required. You may create an account using only a randomly generated account number.
• You are solely responsible for keeping your account number, subscription URL, and recovery secret safe. We cannot recover lost credentials.
• You must be at least 18 years old to use the Service.
• You must not share your subscription URL publicly or resell it.
• One account per natural person, unless a multi-device plan is explicitly purchased.

4. Payment Terms

• Payments are processed exclusively through OxaPay, a non-custodial cryptocurrency gateway. Supported assets include BTC, ETH, USDT (TRC-20/ERC-20), TON, LTC, and others listed at checkout.
• All prices are denominated in USD and converted at the live exchange rate at the moment of invoice generation.
• Subscriptions are non-recurring; you must manually renew before expiration.
• We do not store any payment instrument data. OxaPay only forwards us a transaction reference and a paid/unpaid flag.
• Late or under-paid invoices will not extend your subscription. Over-paid amounts up to 10% are credited automatically; larger overpayments require contacting support.

5. Refunds

All paid plans are covered by a 30-day money-back guarantee. Full conditions are described in our Refund Policy. Refunds are paid back in the same cryptocurrency at the original USD-equivalent value, minus on-chain network fees.

6. Prohibited Use

While we believe in privacy, the Service must not be used to harm others. The following activities are strictly forbidden and will result in immediate, permanent termination without refund:

• CSAM (child sexual abuse material) — zero tolerance, reported to NCMEC and INHOPE.
• Distribution of malware, ransomware, viruses, worms, or trojans.
• Phishing, identity theft, or financial fraud.
• DDoS attacks, port scanning, brute-force attacks, or any unauthorized access to third-party systems.
• Spamming (email, SMS, comment, forum, or messaging spam).
• Trafficking in illegal weapons, narcotics, or stolen data.
• Terrorism-related activities or content.
• Any activity that violates the laws of your local jurisdiction.

7. DMCA & Copyright

We respond to validly formed DMCA takedown notices. Because we keep no logs, we cannot link infringing traffic to a specific user — but we will terminate the accounts of repeat infringers when notified through proper legal channels. Full procedure: /dmca.

8. Termination

We may suspend or terminate your account if:

• You violate Section 6 (Prohibited Use) or our Acceptable Use Policy.
• You attempt to attack, reverse-engineer, or otherwise interfere with our infrastructure.
• You share your subscription URL publicly or commercially.
• You request termination yourself, at any time, via support.

Voluntary cancellation can be performed via the dashboard or the Telegram bot and takes effect immediately.

9. Service Availability

We target 99.9% monthly uptime. Scheduled maintenance is announced in advance. We make no guarantee against blocking by hostile networks (e.g., national firewalls), force majeure events, or upstream provider outages.

10. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, OmniShield, its operators, owners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total cumulative liability shall not exceed the amount you paid us in the previous three (3) months.

12. Indemnification

You agree to indemnify and hold harmless OmniShield against any claims, damages, or expenses arising from your violation of these Terms or your misuse of the Service.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of the offshore jurisdiction in which OmniShield is incorporated, without regard to conflict-of-law principles. You agree that any legal action must be brought exclusively in the courts of that jurisdiction.

14. Dispute Resolution

Before commencing any legal action, you agree to attempt to resolve the dispute by contacting [email protected]. We will respond within 14 days. Unresolved disputes shall be settled by binding arbitration administered under the rules of the UNCITRAL Arbitration Rules.

15. Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions shall remain in full force and effect.

16. Changes to Terms

We may modify these Terms with at least 14 days' notice via Telegram and on this page. Continued use after the effective date constitutes acceptance.
